Terms of Use

1. Acceptance of these terms

These Terms of Use (“Terms”) govern your access to and use of theacademyengine.com and its content, tools, assessment, and downloadable resources (together, the “Site”), operated by Justin Seeley (“we,” “us,” or “our”). By visiting the Site, taking the assessment, or downloading any resource, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

The Site is intended for professional use by individuals who are at least 18 years old, or the age of majority where they live. By using the Site you confirm that you meet that requirement.

3. Permitted use

We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site and to use its content and downloadable resources for your own internal business, educational, or professional purposes.

You may:

  • Take the assessment and share your own results within your organization;
  • Use the frameworks and toolkits to plan or improve your own programs;
  • Quote short excerpts with clear attribution to The Academy Engine and a link back to the Site.

4. Restrictions

You may not:

  • Resell, sublicense, rent, or redistribute the content or downloads;
  • Republish the frameworks, diagrams, or PDFs — in whole or substantial part — as your own work, or remove trademark and copyright notices;
  • Use the content to deliver paid training, consulting deliverables, or certification programs without our prior written permission;
  • Scrape, crawl at abusive volume, reverse engineer, or attempt to bypass any technical restriction on the Site;
  • Use the Site or its content to train machine learning or generative AI models without our prior written permission;
  • Interfere with the Site’s operation or security, or use it for any unlawful, misleading, or infringing purpose.

5. Intellectual property and trademarks

The Academy Engine, the GROWTH™ Framework, the REI™ Model, and all copy, diagrams, illustrations, assessment questions, scoring logic, and PDFs on this Site are owned by Justin Seeley and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

The names and logos identified above are our trademarks. You may not use them in a way that suggests sponsorship, affiliation, endorsement, or certification without our written permission.

6. Feedback and analysis inputs

Feedback. If you submit or otherwise provide us with ideas, suggestions, comments, or other feedback regarding the Site, our products, or our services (“Feedback”), you acknowledge that the Feedback is not confidential. You retain any ownership rights you may have in your Feedback, but you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid-up license to use, reproduce, modify, adapt, publish, distribute, display, perform, and otherwise exploit the Feedback for any lawful purpose, including to develop, improve, market, and provide our products and services, without compensation or attribution to you. You represent that you have the rights necessary to provide the Feedback and grant this license. This provision does not affect our obligations regarding personal information under our Privacy Policy or applicable law.

Analysis Inputs. Information or data you submit to an interactive analysis or assessment tool on the Site (“Analysis Inputs”) remains yours and is not considered Feedback. Analysis Inputs are used only as necessary to provide the requested analysis and operate, secure, and maintain the Site. We do not use Analysis Inputs to develop or train models or for unrelated purposes.

7. Analysis tools and results

Any analyses, scores, metrics, assessments, recommendations, or other results generated through the Site (“Results”) are provided for general informational and educational purposes only. Results are based on the information submitted by the user and may be incomplete, inaccurate, or unsuitable for a particular purpose.

Results should not be relied upon as professional advice or as the sole basis for significant educational, employment, admissions, personnel, financial, legal, or other decisions. You are responsible for evaluating the Results and determining whether they are appropriate for your circumstances.

We do not guarantee the accuracy, completeness, reliability, or suitability of any Results.

8. Third-party sites and services

The Site links to third-party services such as LinkedIn, YouTube, and justinseeley.com, and may embed third-party content. We do not control those services and are not responsible for their content, availability, terms, or privacy practices.

9. Availability and changes to the Site

We may add, modify, suspend, or discontinue any part of the Site — including the assessment, downloads, and course offerings still in development — at any time and without notice. We do not guarantee uninterrupted or error-free availability.

10. Disclaimer of warranties

The Site and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising out of or related to your use of the Site. Our total aggregate liability for any claim relating to the Site is limited to the greater of the amount you paid us, if any, in the twelve months before the claim, or one hundred U.S. dollars (US$100).

To the fullest extent permitted by law, Justin Seeley’s total liability arising out of or relating to the Site, its content, downloads, analyses, or these Terms will not exceed $100.

12. Indemnification

You agree to indemnify and hold harmless Justin Seeley from any claims, damages, losses, and reasonable legal fees arising from your misuse of the Site, your breach of these Terms, or your infringement of any third party’s rights.

13. Termination

We may suspend or terminate your access to the Site at any time if you violate these Terms or misuse the content. The sections on intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

14. Governing law

These Terms and any dispute arising out of or relating to these Terms or your use of the Site will be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law principles, and applicable federal law. Nothing in these Terms limits any rights or protections available to you under applicable law that cannot lawfully be waived or limited by agreement.

15. Changes to these Terms

We may revise these Terms as the Site evolves. We will update the “Last updated” date above when we do, and continued use of the Site after a change means you accept the revised Terms.
